Unauthorised Building Works
Constructing a building or structure without a valid building permit is a breach of Western Australia's building legislation. The Shire of Narrogin is committed to maintaining the safety, health, and amenity of our community, and ensuring all building work meets the required standards.
What is Unauthorised Building Work?
Unauthorised building work refers to any building activity that required a permit but was commenced or completed without one.
It is an offence under the Building Act 2011 to carry out such work without approval, and penalties may apply.
🔍 Important: Even if you purchase a property with unauthorised structures, you inherit the legal responsibility for those works. Always carry out proper due diligence when buying established properties.
The Shire’s Approach to Compliance
The Shire of Narrogin’s preference is for voluntary compliance and a cooperative approach when addressing unauthorised works.

If you are contacted by the Shire about building compliance, we encourage you to work constructively and proactively with our team.

In cases of resistance or non-compliance, the Shire may proceed with formal action or prosecution.

If you receive a Building Order, it is critical that you act within the specified timeframe to avoid legal consequences.
How Are Unauthorised Works Approved?
Local governments cannot issue retrospective building permits for unauthorised works.
Instead, such works must be recognised through a Building Approval Certificate.
This process involves:

Do I Need Other Approvals?
In some situations, retrospective planning approval may also be required.
If planning issues are identified:

Your Building Approval Certificate application may be placed on hold

If the planning application is refused, the building certificate will also be denied

What Do I Need to Apply for a Building Approval Certificate?
To submit your application, you’ll need the following:

Certificate of Building Compliance (BA18) from an independent building surveyor

All supporting documentation referenced in the BA18

Finding a Building Surveyor
An independent building surveyor is required to assess and certify the unauthorised structure. You can find registered surveyors via the Building Commission of WA:
